End-User Licence Agreement
Punch — AI Companion Application
MODEL 5 podjetje za organizacijo, izvedbo, posredovanje d.o.o., Poljanski nasip 12, 1000 Ljubljana, Slovenia — reg. no. 2264994000, VAT SI 72347422. This EULA governs the software of the Punch application and supplements the Terms of Service. If there is a conflict about software licensing, this EULA controls; for service use generally, the Terms of Service control.
1. Licence grant
Subject to your compliance, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the App on devices you control, for personal, non-commercial use only.
2. Restrictions
- No copying, modifying, distributing, selling, or leasing the App.
- No reverse-engineering, decompiling, or deriving source code, except to the extent this restriction is prohibited by law.
- No removing proprietary notices; no circumventing technical protections or usage limits.
- No use to build a competing product or model.
3. Ownership
The App is licensed, not sold. All rights, title, and interest in the App and its models remain with the Company and its licensors.
4. Updates
We may provide updates, which this EULA covers. Some updates may be required for continued use.
5. App-store terms
If you obtained the App from the Apple App Store or Google Play, the applicable store's terms also apply, including the Apple "Licensed Application End User License Agreement" where relevant. Apple/Google are not responsible for the App or support. The store is a third-party beneficiary entitled to enforce this EULA against you.
6. Termination
This licence ends automatically if you breach it; on termination you must stop using and delete the App. Ownership, restrictions, disclaimers, and liability provisions survive.
7. Disclaimers and liability
The App is provided "AS IS". The warranty disclaimers and limitations of liability in the Terms of Service apply and are incorporated by reference.
8. Export and compliance
You represent you are not located in an embargoed jurisdiction or on a restricted-party list, and will comply with applicable export-control and sanctions laws.
9. Governing law
Governing law and dispute resolution follow the Terms of Service (Slovenia for non-U.S. users; U.S. governing law and arbitration for U.S. users).
